EVERY DOCUMENT YOU NEED TO DECIDE IS HERE.
As
the 2nd worst year of my life comes to a close (2008 was obviously
pretty bad too), all I can now do is wait and see what a three-judge
panel for the Arizona Court of Appeals decides; and what the five justices of the Arizona Supreme Court
decide; neither of which will happen until (likely) late in 2010. I
plan to file a motion to consolidate both cases in the Supreme Court,
since they have virtually all the same claims.
The facts I was held at knifepoint in my own apartment, spit on, and extorted for money ,
which forced me to protect myself with my gun, no longer even matter
(more on that later). But three realities make this whole saga
impossibly difficult: the law and U.S. Constitution mean nothing in
Arizona; my pro-se energy is running extremely low; and this State,
like most others, treat you like a leper when you decide to represent
yourself in criminal cases. I can only hope after spending 1500+ hours
in the ASU law library in the past nine months, and countless more
hours in Maricopa County's records department, the appeals court judges
have at least some integrity.
I'm going to make this as
elementary as possible, so even those of you who've never read a court
document or know nothing about the law will be able to easily
understand why I believe this "felony conviction" Maricopa County and
pansy Andy Thomas handed me back on March 30 should be reversed and dismissed by the higher courts. But again, this is Arizona and the law means very little.
Though I first filed a petition for federal habeas corpus, the U.S. District Judge denied the petition, ruling I must first exhaust all state remedies before a federal court can review the persecution.
I then had to file one of those useless, retarded, waste of time Rule 32 Petitions For Post-Conviction Relief in
the Maricopa County Superior Court on July 13. I knew it would be a
charade, but in order to move the case to a higher (and hopefully
honorable) court, I first had to endure this crap. It got to the point
of being such a juvenile clown show, led by Maricopa County judges Gary
Donahoe, Teresa Sanders, and Emmet Ronan, I had to file a Petition for Special Action in the Arizona Court of Appeals just to get these judges to follow the law.

This Sheriff Leon Lott, in a lame attempt to get media attention, thought he could arrest swimming artiste Michael Phelps, based solely on a photo of Phelps taking a bong rip. That would set a hell of a precedent, Leon. Ever heard of Myspace and Facebook pictures? Obama's $800 billion stimulus would have to all be spent on hiring a few million internet agents to arrest people caught smoking weed in pictures. Guess Lott got the 15 minutes he was looking for.
Leon Lott, who sounds a lot like Leon Lett (say that 5 times fast), probably feels like the bigger doofus than even Lett in his hay-day!

This day corresponds with Friday, July 25, 2008. Advisory: contains some adult language.
"Wilkins!" I heard a voice while I was half-sleep at about 645am. I was cold, tired, and my neck was ALL messed up from "sleeping" - if you want to call leaning my head on a cold metal table while sitting on a cold, concrete "chair" - sleeping. "Wilkins!!" I had forgotten where I was, but the voice through the intercom snapped me back to reality. "What?"
"Come down for medical!" the voice said. I had already been through this medical mess once at "the Matrix" and wasn't particularly in the mood for it, so I told myself to just play "toy" with them and get it over with. Before you actually get to medical though, the holding tank - where the people can have staph infections, the flu, or are waiting for psychiatric therapy - is at best 15X15. And a guy in there just happened to be taking his morning shit...about 2 feet away from me!

I must first thank tempepolicecloset.com for setting up an incredibly necessary and informative website. All of the tapes you are about to listen to were obtained from their site. I suggest anyone who comes across this blog, to peruse tempepolicecloset.com if you want to read more about this thug organization that calls itself a police department. Some, including Tempe's City Manager and City Attorney, have questioned the timeliness (since they are from around 1997) and authenticity of the tapes. The aforementioned individuals, according to tempepolicecloset.com, are also not allowing the FBI to review a full, unedited version of the tapes to verify their authenticity.
In light of the notice of claim I filed against the City of Tempe and the Tempe Police Department, this information further substantiates my claim of the Tempe Police intentionally lying to the public to cover their negligence the night I was arrested. It also furthers my point these thugs have little to no integrity and should not be allowed to wear a badge while acting under color of law with their playground, country club mentalities.

INTRODUCTION:
European American ("white") women are rarely murdered (as "black" men frequently are) by thug cops in America, but are frequently Tasered, raped, assaulted, or sexually assaulted. Nubian ("black") Americans first had to "win freedom" from inbred Euro-males in 1868, with the help of European American women. Women than had to battle for another 50 years before they were "allowed" to vote on this country, in 1919. Since then, as I mentioned in the video "55 Days In Maricopa County Jail and U.S. Media," inbred Euro-males who cannot and will not accept and/or adjust to women and "blacks" being equal humans to them join thug police gangs. Joining police gangs allows these thugs to murder, rape, assault, and/or incarcerate any American they choose without repercussion, besides "paid administrative leave." Thug cops only have to complete a 4-6 month "training course" to be a licensed killer or rapist. The United States has become a total police state since the 1960s, after Nubian Americans and women were forced to fight for the rights they are born with. Insecure, inbred, thug Euro-males and "Michael Steele/Booker T. Washington"-type "black" males think they own the rights to life and liberty of all "blacks" and women. Cops are never prosecuted or even remotely punished for the "strict liability" offenses they continually victimize American citizens with.

Friday the 13th turned out to be Whitney Jurjevich's lucky day. Authorities in Montgomery County, PA have decided not to press charges against Jurjevich, the Tempe Police Officer who shot and killed Stan Rosenblatt's dog, Bruce, while visiting his father January 16. According to the press release, Jurjevich had the right to carry the gun, and the right to shoot the dog because he said he felt threatened.

#8: Illegal Discharge of Firearm Charge: Kill or Go to Jail

In hindsight, after reviewing Arizona statutes, I should have shot and killed the radical who extorted and attempted to rob and assault me while he was in my place. A dead suspect with knife in hand, according to several law types and others I've spoken to, would have likely put me in a better situation.
For those of you unfamiliar with Shannon's Law, a statute making it a felony to "negligently" discharge a firearm in a city's limits, it was enacted in 2000 after Shannon Smith, an eighth grade girl, was struck in the head by a stray bullet. She died instantly. Smith parents successfully lobbied to have the law changed from a simple misdemeanor to a felony all across the state. It was intended to stop people from randomly firing guns in the air on New Year's Eve and other holidays, in celebration or for simple fun. I agree whole-heartedly with the statute.

This is exactly what happened to Mr. Tyler Heilman; a 24-year-old who was murdered in cold-blood by Le Sueur County police thug Todd Waldron on July 20. Mr. Heilman was wearing only swimtrunks, thus the proverbial "he was reaching for a weapon" excuse cannot be used by thug Waldron. According to the thug cop, who was not in uniform when he committed the murder, Mr. Heilman was "swerving" and "speeding" down a street in Kasota, MN. Thug Waldron, of course, said Mr. Heilman "resisted," which, in thug cop world, gave Waldron the authority to fire four bullets at Mr. Heilman, killing him instantly.

#10: Day 8: The Court Date

This day corresponds with Tuesday, July 29. Court Dates were all the same; with slight variations. The first was the worst in every way since I had yet to experience actually GETTING to court.
Around midnight of the day you go to court, a guard will speak to you through the intercom in your cell. "Wilkins...you want to shower and shave for court?" Sure I'd love to shave, but not with the cheap, disposable razors they give you. Plus I guess it would have been too humane a gesture for them to provide shaving cream (which they did not).
You are called from your cell again around 4 a.m. The guards give you "clean stripes," (shirt and pants) but you're not given clean boxers or socks. This small act of humanity could have at least been reserved for when you returned to jail from court. You are then told to put your hands on a wall and spread your legs. Chains are then wrapped around each of your ankles, leaving you with maybe 30 inches of chain to walk with. You could take steps only as big (or small) as the chains allowed. Next you are told to turn around and put your hands in front of you with your thumbs up. Handcuffs are then snapped around your wrists, then the guards chain your handcuffs to another person's handcuffs. There is maybe 3 feet of chain between you and the guy you were chained to.

The REPO Act - which stands for Reform for the Education of Police Officers - is Operation Nation's proposal for federal legislation requiring all officers of the law in all cities with a population larger than 50,000, to have a 4-year bachelor's degree from a nationally accredited university or college. The Act will also require mandatory U.S. Dept. of Justice review of any and all murders, rapes, and assaults committed by police; will end the affirmative defense of "qualified immunity" for police in civil action; and will require a mandatory five year minimum prison sentence for any police officer found guilty of negligent homicide, manslaughter, or murder; and a mandatory minimum two year sentence for all unjustified assaults. Provisions will also be in place so judges and prosecutors no longer have Eleventh Amendment immunity from civil liability in clear cases of abuse of power.
Once all the details are ironed out, Operation Nation will begin gathering signatures in hopes to get this proposal either on a national ballot or passed through Congress.

No Euro-Americans were charged for any crimes, further illustrating the USA will go to any lengths to keep "their blacks" enslaved to their rules and desires. Hundreds more prosperous "African American" communities were invaded and destroyed by Confederites, police, and National Guard in this time period as well, which are all dismissed in U.S. and European history books as "race riots," if they are mentioned at all. This dual communist system for "blacks" and capitalist system for Euro-Americans continues today with the holocaustic activities of the U.S. Justice System, deliberate deficiencies in education, and a monopolized Euro-American media.
